Brief Synopsis: It is nearly a quarter of a century since the publication of the Fifth Edition of Garrow and Kelly’s Law of Trusts and Trustees. In that time trusts in New Zealand have developed from a specialist area of law to a growth industry. The increasing popularity in particular of “family trusts” has brought with it many changes both in the law and practice which are reflected in this edition.
This edition gives detailed consideration to such recent developments as protectors, appointers, sham trusts, and the rule in Hastings-Bass. The chapter on trust investment has been completely rewritten in the light of the 1988 changes to the Trustee Act. Other new material includes a glossary, a table summarising trustees’ statutory powers, a discussion of the Charities Act 2005, and comment on the interface with family law, especially the Property (Relationships) Act 1976 and what is now commonly referred to as “trust busting”.
The authors of the Sixth Edition provide a reliable source of accurate and extensive analysis of the area. Using local and international case law, Noel Kelly, Chris Kelly and Greg Kelly provide practitioners with an insight into what is a core and practical area of law.
